گروهی از وکلای کانادایی ایرانی تبار طی نامه‌ای سرگشاده به جاستین ترودو نسبت به بازگشایی سفارت‌خانه و از سرگیری روابط با ایران در این مقطع هشدار دادند.

نخست‌وزیر گرامی،

ما گروهی از وکلای کانادایی ایرانی تبار که با جوامع ایرانی کانادایی این کشور در ارتباط هستیم، ادعای نمایندگی از سوی همه ایرانی کانادایی‌ها را نداریم.  در حالی که می‌پذیریم عده‌ای از ایرانیان خواستار برقراری مجدد روابط دیپلماتیک کانادا با جمهوری اسلامی ایران هستند، ولی تأیید می‌کنیم که چنین نظری متعلق به همه ایرانیان ساکن کانادا نیست و این افراد در وهله‌ی اول خواسته‌ها و صدای لابیست‌های رژیم ایران را منعکس می‌کنند.

به دنبال حمله اخیر سپاه پاسداران ایران به هواپیمای اوکرائینی (پرواز ۷۵۲)، ما تصمیم گرفتیم تا این نامه را به شما ارسال کنیم با این هدف که انعکاس‌دهنده‌ی نظر بسیاری از ایرانی – کانادائی‌هایی باشیم که مخالف برقراری مجدد روابط دیپلماتیک کانادا با جمهوری اسلامی هستند.  این نظر بسیاری از ایرانی – کانادائی‌هایی است که در سرتاسر کشور کانادا مقیم می‌باشند.

ما به کانادایی بودن خود افتخار می‌کنیم و از دولت کانادا بابت ارتباط فعال و نزدیکش با خانواده‌ها و وابستگان عزیزان از دست رفته در این واقعه قدردانی می‌نماییم.  پی‌گیری دولت کانادا را برای دست یافتن به حقیقت و دادخواهی برای خانواده‌های جانباختگان این واقعه را نیز مثبت ارزیابی می‌کنیم.

جنایات جمهوری اسلامی علیه مردم ایران از بیش از چهل سال پیش شروع شده و پدیده‌ی تازه‌ای نیست.  به همین خاطر به نظر ما برقراری مجدد روابط دیپلماتیک با جمهوری اسلامی در شرایط فعلی در جهت عکس تلاش‌های مردم ایران خواهد بود که برای برقراری حقوق بشر و دموکراسی در ایران مبارزه می‌کنند.  جمهوری اسلامی از بدو شکل‌گیری تا امروز به سرکوب مردم ایران پرداخته است که چند نمونه را در ادامه مثال خواهیم زد.

به نظر ما دولت کانادا باید قدم‌های محکم‌تری در جهت پشتیبانی از مردم ایران و مخالفین رژیم که اعتراضات خود را به صورت صلح‌آمیز برای دست‌یافتن به حقوق بشر و دموکراسی ادامه می‌دهند، بردارد.  حمایت از مخالفان رژیم جمهوری اسلامی همگون با منافع کانادائی‌ها، ایرانی‌ها و جامعه بین‌‌المللی است.  حمایت از دموکراسی و حقوق بشر از یک طرف و برقرای روابط دیپلماتیک با جمهوری اسلامی از طرف دیگر کاملا با هم ناسازگار و متضاد است.

به همین خاطر ما از شما می‌خواهیم که هیچ حرکت و اقدامی نکنید که بشود این تعبیر را از آن کرد که کانادا قدم در جهت قانونی کردن رژیم جمهوری اسلامی برمی‌دارد در حالی که این رژیم کاملاً فاقد اعتبار قانونی است. برقراری مجدد روابط دیپلماتیک با جمهوری اسلامی ایران در این برهه درست نیست.

یکی از اولین جنایات تروریستی اسلامیست‌ها در ایران که در سال ۱۹۷۹ قدرت سیاسی را از آن خود کردند، در تاریخ ۱۹ آگوست ۱۹۷۸ در یک سالن سینما در آبادان ایران به نام سینما رکس اتفاق افتاد.  در آن روز وحشتناک، اسلامیست‌ها سینما را به آتش کشیدند و ۴۷۰ ایرانی که فیلمی را تماشا می‌کردند جان خود را از دست دادند.  همین طور که امروز جمهوری اسلامی ایران ایالات متحد امریکا را برای موشک‌پرانی سپاه پاسداران به پرواز ۷۵۲ هواپیمایی اوکراینی سرزنش می‌کند، آن موقع نیز اسلامی‌ها به دروغ شاه ایران را مسبب جنایت سینما رکس اعلام کردند و موفق شدند میلیون‌ها ایرانی را فریب دهند که این دروغ را باور کردند و برای اعتراض به خیابان‌ها آمدند.  دهها سال بعد این دروغ افشا شد و امروز کاملا مشخص شده است که فاجعه سینما رکس آبادان یک اقدام تروریستی از جانب اسلامیست‌هایی بود که به دنبال کسب قدرت سیاسی در ایران بودند.

وقتی در سال ۱۹۷۹ جمهوری اسلامی ایران روی کار آمد، زنان، اعضای LGTBQ2، اقلیت‌های مذهبی (و هم چنین آگنوستیک‌ها و آتیست‌ها)، اقلیت‌های قومی، آزاداندیشان و مخالفان سیاسی همه و همه سرکوب شده و با احکام قوانین اسلامی مواجه شدند.  در سال ۱۹۸۸، رژیم خمینی حدود ۵ هزار زندانیان سیاسی را پیرو فتوای خود آیت‌الله خمینی رهبر آن وقت جمهوری اسلامی کشت.

در سال ۲۰۱۳، دولت وقت کانادا با حمایت همه احزاب دیگر کشتار زندانیان سیاسی ایران را در سال ۱۹۸۸ جرمی علیه بشریت اعلام کرده و محکوم کرد.  بسیاری از سران کنونی رژیم اسلامی ایران هم چون – ابراهیم رئیسی که رئیس قوه قضائیه ایران است در کشتارهای سال‌های ۱۹۸۰ نقش مستقیم داشتند.

در سال ۲۰۰۳، زهرا کاظمی، یک فتوژورنالیست ایرانی – کانادایی در زندان اوین شکنجه و کشته شد.  او در جلوی زندان اوین هنگامی که از تظاهرات صلح‌آمیز مردم عکس می‌گرفت بازداشت شد و بعد در همان زندان شکنجه و کشته شد.  در آن زمان کانادا با ایران روابط مستقیم دیپلماتیک داشت و در تهران سفارت کانادا فعالیت داشت.  با این حال این روابط دیپلماتیک و داشتن سفارت هیچ کمکی به دست یافتن به حقیقت و دادخواهی برای زهرا کاظمی نکرد.

دیپلمات‌های کانادا نه موفق شدن به حقیقت دست یابند و نه توانستند پیکر این کانادایی را به کانادا برگردانند – چیزی که خواسته پسر زهرا کاظمی بود.

در نوامبر ۲۰۱۹ (آبان ماه امسال) به گزارش رویتر حدود هزاروپانصد ایرانی معترض و حتی عده‌ای رهگذر تنها در طی چند روز در خیابان‌های ایران به دست مأموران جمهوری اسلامی جان خود را از دست دادند.  خانواده‌های این جان باختگان مورد آزار و اذیت مأمورین قرار گرفته و حتی بعضی زندانی شده و همگی از صحبت با خبرنگاران در مورد جنایات رژیم در این چند روز و کشته شدن عزیزانشان منع شدند.

حوصله این نامه اجازه نمی‌دهد که حتی گوشه‌ای از جنایات جمهوری اسلامی ایران را برای شما لیست کنیم.  مثال‌های بالا تنها نمونه‌هایی است برای برجسته کردن ماهیت این رژیم و شدت خشونت و سرکوب‌گری آن است.

رژیم حاکم در ایران بعد از این که سپاه پاسدارانش در ۸ ژانویه ۲۰۲۰، پرواز ۷۵۲ را مورد حمله قرار داد و ۱۷۶ سرنشین آن را که ۵۷ تن آن‌ها کانادایی بودند کشت،  به مردم ایران دروغ گفت.  زمانی که رژیم ایران مجبور شد مسئولیت این حمله و کشتار را بپذیرد، مردم ایران به خیابان‌ها آمدند و علیه این واقعه و دروغ‌های دولت اعتراضات سرتاسری به پا کردند.  جواب رژیم ایران هم چون همیشه سرکوب تظاهرکنندگان بود.

به همین خاطر الان زمان آن نیست که با برقرار کردن روابط دیپلماتیک با ایران، کانادا دولت جمهوری اسلامی ایران را تقویت کند.  چنین حرکتی خون جانباختگان پرواز ۷۵۲ و دیگر جنایات این رژیم را علیه مردم ایران و همین طور در عرصه جهان نادیده می‌گیرد.

هم چنین ما از دولت کانادا می‌خواهیم که عدالت را برای خانواده‌های پرواز ۷۵۲ از کانال دولت ایران دنبال نکند.  ما می‌خواهیم که کانادا یک تیم بین‌المللی را برای حقیقت‌یابی رهبری کند.

آنانی که در جنایت پرواز ۷۵۲ مجرم هستند، نباید مسئول و یا شریک در تیم حقیقت‌یابی این جنایت شوند.  کانادا می‌بایست یا از طریق سازمان ملل و یا از طریق مرجع بین‌المللی دیگری هم چون برپایی یک گروه حقیقت‌یاب کاملا مستقل از ایران، حقیقت کامل را در مورد این جنایت و نقش ارکان مختلف جمهوری اسلامی ایران در آن را با شفافیت برملا کند.  نمونه چنین تلاش بین‌المللی را دولت دانمارک در پی سانحه هوایی سال ۲۰۱۴ در اوکرائین انجام داده و نمونه‌ای است که کانادا می‌تواند دنبال کند.

مردم ایران مبازات شجاعانه خود را علیه این رژیم تشدید کرده‌اند.  مردم ایران خواهان براندازی این رژیم هستند و خواسته آنان از کانادا فشار بیشتر روی رژیم و منزوی کردن جمهوری اسلامی از لحاظ سیاسی در عرصه جهانی است.

در پایان ما از دولت کانادا خواستاریم تا در زمان مناسب، از دادگاه بین‌المللی (International Court of Justice) برای خانواده‌های جان باختگان پرواز ۷۵۲ طلب غرامت بکند.  شکایت رسمی دولت کانادا به این مرجع بین‌المللی علیه جمهوری اسلامی ایران و جنایتی که با کشتار سرنشینان پرواز ۷۵۲ انجام داده است به موقع خود برای دادخواهی عزیزان از دست رفته ضروری است.

OPEN LETTER TO PRIME MINISTER TRUDEAU

Dear Prime Minister Trudeau,
We write as a group of Canadian lawyers of Iranian heritage and with connections to the Iranian
Canadian communities in Canada.

We do not represent all Iranian Canadians, and while we acknowledge that some Iranian
Canadians support the re-establishment of diplomatic ties with the Islamic Republic of Iran, we
want to stress that these views do not represent all Iranian Canadians, and primarily voice the
desires of lobbyists for the Iranian regime.

In particular, given the recent downing of Ukrainian International Flight 752 (“Flight 752”) by
the Islamic Republic of Iran’s Revolutionary Guards, we decided to write to you to provide an
argument contrary to re-establishing diplomatic ties with Iran, a position that many share with us
in the various Iranian Canadian communities across Canada.

We are proud to be Canadians and express our gratitude to the government of Canada for its
active engagement with the families and friends of those who lost loved ones in the missile
attack on Flight 752. We are further encouraged to witness our government’s pursuit of justice
for the families, and the government’s drive in pressing for the facts of this incident to be fully
investigated and known.

Since the atrocities of the Islamic Republic of Iran against its own people go back to its
inception, and have been relentlessly ongoing for more than forty (40) years, as we outline
briefly below, it is our view that re-establishing ties would undercut the efforts of the people in
Iran who are peacefully protesting their government in support of human rights and democratic
change.

The government of Canada should, in our view, take stronger steps to support the people of Iran
who are peacefully protesting for human rights and democracy. Supporting the protestor’s quest
for human rights and democracy is in the interest of Canadians, Iranians, and the global
community, and is incompatible with establishing relations with Iran’s government.
As such, we urge you not to take any action which may be interpreted as legitimizing an
illegitimate regime, such as formalizing ties with the regime of Iran.

One of the first acts of terrorism of the Islamists in Iran who took power in 1979 occurred on
August 19, 1978 in a theatre in Abadan, Iran called Cinema Rex. On that horrible day, the
Islamists set the theatre on fire and burned 470 Iranians who were watching a film. Just as the
regime is now blaming the United States government for the Revolutionary Guards’ missile
downing of Flight 752, at that time the Islamists blamed this act of terrorism on the then Shah of
Iran, and successfully mobilized millions of Iranians against the Shah’s regime based in part on
this false accusation. The truth was unveiled decades later, and it is now well known that the
Cinema Rex Fire was perpetuated by Islamists in Iran.

Once the Islamic Republic of Iran was established in 1979, women, members of the LGTBQ2
communities, religious minorities (including agnostics and atheists), ethnic minorities, free
thinkers and political dissidents all became subjected to overt persecution in accordance with the
Sharia law. In 1988, the Khomeini regime massacred an estimated five thousand (5000) political
prisoners in Iran following a direct fatwa from Ayatollah Khomeini himself, the Supreme leader
at the time.

The Canadian government and opposition MPs joined forces to recognize the 1989 killings of
political prisoners as a crime against humanity in 2013.

Many of the current high-ranking officials of the Iranian regime including Ebrahim Raisi, the
current head of the Judiciary in Iran, directly participated in the killings of the 1980s.
In 2003, Zahra Kazemi, an Iranian-born Canadian and a photojournalist, was tortured to death in
the notorious Evin prison in Iran after she was arrested while taking pictures of peaceful
protesters near the very prison in which she was herself later flogged, raped and killed. Canada
had official diplomatic ties with Iran at the time, including an embassy in Tehran. Yet the
Canadian embassy was neither capable of unravelling the truth of what happened to this
Canadian citizen, nor able to bring the remains of Zahra Kazemi to Canada for burial as her
Canadian son had wished.

Most recently, in November 2019, approximately fifteen hundred (1500) peaceful protestors and
some bystanders were killed in just a few days on the streets of Iranian cities, according to
Reuters. The families of those killed were subsequently harassed, intimidated and in some cases
detained and barred from mourning publicly or speaking to the media about their loved ones.
To list even a fraction of the atrocities committed by the Islamic Republic of Iran is beyond the
scope of this letter. The examples above are only a few to underscore the very nature of this
regime being one of extreme intolerance, brutality and oppression.

The Iranian regime knowingly lied to its people and to the world for days after its revolutionary
guards attacked Flight 752 on January 8, 2020 and killed all 176 passengers on board including
fifty-seven (57) Canadian nationals. Once the Iranian government admitted to this, Iranian
people protested in large numbers all over the country and demanded justice and for the
leadership in Iran to be held accountable. The response of this regime was to crack down on the
demonstrators, once again.

This is, therefore, not the time to bolster the Iranian regime through establishing diplomatic ties
with it. To do so would be to look the other way when it comes to the Canadian Iranians that
have lost their lives and whose families seek justice, and the many other atrocities the Islamic
Republic of Iran has committed against its people and internationally.

We also urge the Canadian government not to seek justice from the Iranian regime itself, but to
be a leader in an international effort to uncover the unvarnished truth regarding the Flight 752
incident.

Canada should seek justice for the Canadian victims of this incident and their families not
through establishing diplomatic relations with those who are to be prosecuted for this crime, but
to lead the way for the establishment of an independent international body –through the United
Nations or through a Canadian lead team – to investigate the Iranian regime and the
Revolutionary Guards who are responsible for this crime. Just as a Dutch-led international
criminal investigation into the Russian downing of the Malaysian Airline in Ukraine in 2014 was
the only way to uncover the truth of that disaster, we urge Canada to lead a team of reliable and
impartial international experts into a full and transparent investigation of this matter.
The people of Iran are intensifying their courageous efforts to change this regime and they are
looking to Canada for leadership in putting more pressure on Iran and isolating this regime
politically in the world.

Finally, we ask the Canadian government to utilize the International Court of Justice in due
course, and to make a formal complaint to this international court to seek proper compensation
and justice for the Canadian victims of this tragedy.
